Dog Bite Compensation Lawyer in Fort Worth, TX

Helping Clients throughout Texas Seek Full and Fair Compensation

Dogs and other animals can make wonderful pets, but when someone is bitten by one of them, the consequences can be extremely serious. If you have been attacked or bitten by an animal, it is extremely important that you seek medical attention immediately because a wound may require stitches or a rabies shot, and it may also become infected from the bacteria that can be found in an animal’s mouth. Moreover, the trauma associated with an animal attack can have longstanding effects.

We want you to know that you are not alone during this difficult time. Attorney J. Kent McAfee is here to work hard for you and to treat you with sensitivity after you or a loved one has suffered a dog bite.

Important Information about Dog Attacks

In Texas, the ‘one bite’ or ‘first bite’ rule is generally enforced. As to any injury, whether or not it was caused by a bite means a dog owner may not be liable the first time the animal bites someone, but may be responsible in subsequent attacks, because they know the dog is capable of harm. In 2008, the Texas Supreme Court held that a dog owner in Texas “owes a duty to stop the dog from attacking a person, after the attack has begun.” However, a dog bite victim can also recover damages if they can prove that the owner should have known their animal was dangerous and did not take reasonable steps to prevent that danger to others.

Additionally, there are different types of damages you can seek to recover. Medical and non-medical bills are comprised of lost wages, loss of future earning power, pain and suffering, and permanent disfigurement suffered from a dog attack. If you have suffered an animal bite, the claim will usually fall under a premises liability action if it happened on another’s property. Dog bites are the most common form of animal bites, but scratches, nips and scrapes are all forms of animal ‘bite’ personal injury claims that can be made. Investigation of the extent of the injuries, veterinary records and breed research are all important components that can lead to a favorable dog bite claim settlement.
