In Texas, the ‘one bite’ or ‘first bite’ rule is generally enforced. As to any injury, whether or not it was caused by a bite means a dog owner may not be liable the first time the animal bites someone, but may be responsible in subsequent attacks, because they know the dog is capable of harm. In 2008, the Texas Supreme Court held that a dog owner in Texas “owes a duty to stop the dog from attacking a person, after the attack has begun.” However, a dog bite victim can also recover damages if they can prove that the owner should have known their animal was dangerous and did not take reasonable steps to prevent that danger to others.
